Terms of Service

These Terms of Service govern your access to and use of BidBrush AI. By creating an account, starting a trial, purchasing a subscription, or otherwise using BidBrush AI, you agree to these Terms.

If you are using BidBrush AI on behalf of a business, you represent that you have authority to accept these Terms on behalf of that business.

BidBrush AI provides software designed to assist painting contractors with estimating, pricing, proposals, customer responses, revisions, follow-ups, and related business workflows.

We may modify, improve, add, or remove features as the service evolves.

You are responsible for maintaining accurate account information and protecting access to your account. You are responsible for activity performed through your account except where prohibited by applicable law.

You must notify us if you believe your account has been accessed without authorization.

BidBrush AI may offer a 7-day free trial to eligible new users. Unless otherwise stated during signup or checkout, paid access is currently offered at $29 per month after the trial.

Your subscription may automatically renew until canceled. The price, billing interval, trial terms, taxes, and other applicable charges presented during checkout form part of your subscription agreement.

Promotional or future plans may have different pricing and terms.

You may cancel your subscription through the subscription management functionality made available by BidBrush AI or its payment provider.

Unless otherwise required by law, cancellation stops future renewals and does not automatically refund charges already incurred. Access may continue through the remainder of an already-paid billing period where applicable.

BidBrush AI is an estimating and proposal assistance tool. You remain responsible for reviewing every estimate, quantity, rate, scope, material requirement, labor calculation, tax, price, and proposal before sending it to a customer.

BidBrush AI does not guarantee that an estimate will accurately reflect the final cost, time, materials, labor, profitability, or requirements of a particular painting project.

Some features may use artificial intelligence to generate or suggest estimates, scopes, descriptions, proposal content, or other information.

AI-generated output can contain errors, omissions, or unsuitable recommendations. You are responsible for reviewing and approving generated content before relying on it or sending it to a customer.

BidBrush AI should not replace your professional judgment, inspection of a project, or knowledge of applicable business, contractual, safety, licensing, or legal requirements.

You are responsible for the proposals, prices, promises, payment terms, warranties, project descriptions, and other information you send to customers through BidBrush AI.

Acceptance of a proposal through BidBrush AI does not make BidBrush AI a party to the agreement between you and your customer.

You are responsible for ensuring that you are permitted to collect, enter, process, and communicate with customers whose information you use through BidBrush AI.

You must use customer information only for lawful business purposes and in compliance with applicable privacy, communications, marketing, and data-protection laws.

You may not use BidBrush AI to:

• Violate applicable laws or regulations.
• Commit fraud or misrepresent your identity or business.
• Access another user's account or information without permission.
• Distribute malware or interfere with the service.
• Attempt to bypass security, authentication, usage restrictions, or access controls.
• Use the service to send unlawful, deceptive, abusive, or unauthorized communications.

BidBrush AI and its software, design, branding, interfaces, and other service materials are owned by us or our licensors and are protected by applicable intellectual property laws.

You retain ownership of content and business information you submit to the service, subject to the rights necessary for us to process that content and provide BidBrush AI.

We work to keep BidBrush AI available and reliable, but we do not guarantee uninterrupted or error-free operation. The service may occasionally be unavailable due to maintenance, technical failures, third-party services, security issues, or circumstances outside our control.

We may restrict or suspend access when reasonably necessary to protect the service, other users, or third parties; investigate suspected abuse or fraud; address nonpayment; or respond to violations of these Terms or applicable law.

To the maximum extent permitted by applicable law, BidBrush AI is provided on an "as is" and "as available" basis. We do not warrant that estimates, AI-generated content, calculations, proposals, or other output will always be accurate, complete, or suitable for a particular project.

To the maximum extent permitted by applicable law, BidBrush AI and its operators will not be liable for indirect, incidental, special, consequential, or similar damages arising from use of the service, including lost profits, lost business opportunities, incorrect estimates, customer disputes, or loss of data.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

We may update these Terms as BidBrush AI evolves. We will update the "Last updated" date when changes are made and may provide additional notice for material changes where appropriate.
